Terms of Use

Masöz is a guide/directory platform. It does not provide massage services itself, does not act as an intermediary in the provision of services, and does not take appointment or session payments. The Platform's main purpose is to provide a showcase that brings together Visitors looking for services and independent Users who provide them.

For this reason, the Platform gives no guarantee about the quality, safety, legality, accuracy or hygiene conditions of the services provided by Users. All communication, agreements, services and payment processes between a User and a Visitor are independent of the Platform, and the Platform is not a party to this relationship. The Platform cannot be held responsible for any dispute that may arise between the parties.

The disclaimer in this article does not remove the Platform's liability arising from its intent and gross negligence or its liability arising from mandatory legislation.

Both Users and Visitors must be at least 18 years old to use the Platform. To prevent people under 18 from accessing the site, the Platform uses an age declaration gate (+18 confirmation); this gate relies on the person's own declaration. The Platform is not responsible for the actions of people who make a false declaration about their age. If a User is found to be under 18, their profile is deleted immediately and without warning.

Every User who creates a profile on the Platform accepts and undertakes the following:

• Accurate Information: That all information on the profile, such as name, contact details, experience, certificates and service descriptions, is accurate, up to date and their own.
• Legal Responsibilities: That, as an independent service provider, all tax, social security and other legal obligations are entirely their own responsibility.
• Prohibited Content: That they will not, in their profile or in their communication with Visitors, make posts that imply, offer or contain any erotic, sexual, obscene or unlawful service. A violation of this rule is sufficient reason for the profile to be deleted permanently.
• Ban on Medical Claims: That they will not claim that the massage services they offer serve a medical procedure, diagnosis or rehabilitation purpose, and that they will provide services only within the scope of relaxation and professional massage.

Every Visitor who visits the Platform accepts the following:

• Intended Use: That they will use the Platform only to look for professional massage services.
• Ban on Harassment: That they will use respectful language when contacting Users and will not make harassment, threats or inappropriate requests.
• Ban on Copying Data: That they will not copy, reproduce or publish on other media, without the Platform's written permission, content on User profiles such as photos, phone numbers and text.
• Ban on Impersonation and False Information: That they will not create fake profiles in someone else's name or give false information.

To protect the quality and security of the Platform, all newly created profiles and significant changes to existing profiles are reviewed by our editors before they are published. This review process is completed as soon as possible. The Platform reserves the right not to publish, to edit or to remove from publication content it finds contrary to the Terms of Use, misleading or of poor quality.

A “Tested Service” badge may appear on some User profiles. This badge shows that one of the Platform's editors has personally tested the relevant User's service and made a subjective assessment based on that experience. This badge does not constitute a quality guarantee, official approval, certificate or recommendation. The Platform does not undertake that badged services will always be of the same quality and is not responsible for problems that may arise from these services.

The “Masöz” brand, logo, website design, software code and all original content created by the Platform belong to the Platform and are protected by intellectual property laws. Users keep the ownership of the photos and text they upload to their profiles.

For the photos and text the User uploads to their profile, the User grants the Platform, under Law No. 5846 on Intellectual and Artistic Works, a non-exclusive, royalty-free license limited to the duration of membership, covering the rights of reproduction, distribution, communication to the public and adaptation (including translation), for the purposes of publishing this content on the Platform, arranging it to suit screens (such as resizing, cropping and compression) and translating it into other languages. When membership ends, this content is removed from publication; legal retention obligations and the retention periods stated in the Privacy Policy and Privacy Notice are reserved.

The User also permits the Platform to translate the profile description into other languages and to publish, reproduce and display the resulting translations, as an adaptation within the meaning of Law No. 5846 on Intellectual and Artistic Works, for the purpose of providing the service. This permission is non-exclusive and is valid for the duration of membership. Details on the transfer of the description to service providers abroad for translation are in the Privacy Policy and Privacy Notice.

The Platform is a hosting provider under Law No. 5651 on the Regulation of Publications Made on the Internet. The text, photos and contact information on profile pages are user content provided by the user (massage therapist) who creates the relevant profile; as a hosting provider, the Platform is not obliged to monitor this content in advance for unlawfulness. However, all profiles go through an editorial check before publication for compliance with the platform rules (e.g. the ban on +18 content).

Notice and removal (notice-and-takedown): If you believe that content violates your personality rights, your intellectual property rights or the legislation, you can send your request to destek@masoz.app together with the full link (URL) of the content in question, the grounds for the violation and your contact details. Notices are assessed within 48 hours at the latest; content found to be in violation is removed from publication or access to it is blocked, and the person who made the request is informed. Lawful content removal decisions of the competent authorities are implemented immediately.

The Platform keeps the traffic records (IP address, time and action information) of the actions of Users, who are content providers, and of administrators for 365 days (1 year) under Law No. 5651 and deletes them when the period ends. Details are in the Privacy Policy and Privacy Notice.

The Platform reserves the right to temporarily suspend or permanently terminate the account of any User who violates these Terms of Use. In cases of serious violation, unlawfulness or security risk, this action may be applied without prior notice; in other cases the User is notified, and the User can write to destek@masoz.app to learn the grounds of the decision and ask for it to be reviewed again. If an account is terminated, the User's profile is closed to the public. However, records such as identity verification (KYC) documents, the phone number history and the block list may continue to be kept in accordance with the principles set out in the Privacy Policy and Privacy Notice.

A User can request the deletion of their account and profile by writing to destek@masoz.app; the request is fulfilled within thirty (30) days at the latest.

The Platform may change these Terms of Use when it considers it necessary. The current text is published on the Platform and the “Last updated” date is shown. Changes that significantly affect the rights and obligations of Users are notified by email or panel announcement a reasonable time before they take effect; a User who does not accept the change can request the deletion of their account before the effective date. Changes made because of legal requirements and urgent security measures may take effect immediately. Continuing to use the Platform after a change takes effect means that you accept the updated terms.

The User agrees to receive by email service announcements about their account, their profile and the operation of the Platform (changes to rules and terms, maintenance, security, profile reminders, information about new features). These announcements are not commercial electronic messages and are sent independently of commercial message consent. Messages with promotional content (campaign, advertising) are sent only to those who have given separate consent; this consent is optional, is not a condition of membership and can be withdrawn at any time.

The law of the Republic of Turkey applies to the interpretation and application of these Terms of Use. The Istanbul Çağlayan Courts and Enforcement Offices have exclusive jurisdiction for the resolution of any legal dispute that may arise from or in connection with these terms. The mandatory jurisdiction and recourse provisions of consumer legislation remain reserved for Visitors who use the Platform as consumers.

The Platform may use automatic translation to publish Users' profile descriptions in languages other than Turkish as well. The translations are produced automatically and are for information only; they are not guaranteed to be accurate or complete. The Turkish text is binding; if there is a difference between a translation and the Turkish text, the Turkish text prevails. The Visitor is told that a translated text is an automatic translation and how to reach its Turkish original.

A User can write to destek@masoz.app to see the translations on their own profile and to ask for a translation they find incorrect to be corrected or removed from publication. The Platform corrects a reported error within a reasonable time; when a translation containing a claim about a health effect is reported, it is removed from publication immediately. The Platform is not responsible for translation errors arising from slight fault; its liability for intent and gross negligence is reserved.

The versions of these Terms of Use, of the Privacy Policy and Privacy Notice and of the other legal texts on the Platform in languages other than Turkish are for information only; if there is a difference of interpretation, the Turkish text is binding.
